Brand new, hasn't even hit first service hours yet.

It's a intermittent code. When it comes on I lose all acceleration or throttle response, goes away when I let off the throttle. Is this dealership worthy or just a simple little thing to poke and prod at?

And no- I am not holding the brake whilst driving.

This, that switch is a common failure point. When it happens stop and see if the brake lights are on, or if someone is following you ask them if they are on. When the switch goes bad it goes one of two ways: it either looks like you don't hit the brakes when you actually are (and then the machine has issues not starting), or it looks like you are hitting the brakes when you aren't (and the machine reports the code for two foot driving).

If it's new enough and under warranty, the dealer should cover it and fix it, but they may have to schedule it out or order the part and may not get to it right away. Or you could order the part and swap it out yourself, it's pretty straight forward and not a complicated procedure. If you have a good relationship with the dealer, you may be able to pull the bad part and get them to replace it under warranty without the hassle of taking the machine in.
