Not sure how it works there. But in Idaho if you dispute a ticket the office writing the ticket has to show up at court too. So at the very least make his life a bit more uncomfortable.

Here is the actual language from the law. I think it's important although like any law there's always some wiggle room. Link to the law
An individual shall not operate an orv:

(b) Unless the individual and any passenger in or on the vehicle is wearing on his or her head a crash helmet and protective eyewear approved by the United States department of transportation. This subdivision does not apply to either of the following:

(i) The operator of or a passenger in a vehicle that is equipped with a roof that meets or exceeds standards for a crash helmet if the operator and each passenger is wearing a properly adjusted and fastened safety belt.

Certainly your R.o.p.s cage meets that requirement. You need to take documentation that your cage has this certification and what it means. I would bet that a solid roof is not required. According to the statute a jeep would fall under the same rule while being off road. I'm sure they wouldn't ticket a jeep with his top down. Jeeps have a basic roll cage similar to rzrs. Personally I would try to submit this proof to the court before your court date and see if they will dismiss it without having a formal meeting with the officer present.

For the future. Go to the link provided above and become familiar with your orv laws. Printing out the helmet section and others that you might get hassled for might be a good idea so you can show the officer you're trying to abide by the law.

Familyman thank you for posting the link i've been trying to figure it out but you beat me to it. My buddy who I normally ride with has all the laws and road maps printed up and laminated that he carries with him. I think it will be a good idea for me to do the same. I've read thru the rules several times to make sure i'm always in the right but my idea of a roof and the officers was obviously different. I plan to talk to the magistrates office to see if I can get this dismissed without going infront of a judge but if I have to I will if for nothing else but to get some clarification for myself and the officer.

WELL i'm with the ROPS law,but i hate to say it,not to matter about that,because you were breaking the law riding anywhere on the "right of way " of the state..and the judge will bring that up..just because the local cops says it's ok,when you are in court it goes by the book..most of the time..
i'd still show up and fight it.

hahaha excllent...neighbor in Ohio on his farm was hunting groundhogs and a newbe GW came by on the road and jumped his fence and proceeded to write him a ticket,and the old farmer ran him back to the truck and then called the sheriff and got out of the ticket on the spot..

Actually here in Michigan it perfectly legal to ride on the roadsides as long as its not one of the designated not for atv traffic. Problem is the individual townships have to decide whether or not to allow atv travel in thier town. Unionville has yet to decide so as of now it's legal to travel in town and hopefully it remains that way. I know one thing all this bs is definately got me thinking its time to make my rzr street lagal and then maybe some of my troubles will go away.

Nothing new to report on this yet. My court date is set for september 27th. I'll definately post more when I know more. I did talk to 2 other officers and they both told me that what I was doing is perfectly legal so I guess we'll see what the judge thinks.
