Ca Law for cage,seats & Belts

Is there really a law that is going to make it illegal for aftermarket cages, seats and seat belts in UTV's. The law is suposedly going into effect in July 2013 unless it gets ammended like all passengers required to touch the floor with their feet. I have been hearing this from a couple different sources but havent seen it actually in writing yet...Dont say it's true.

NO!

The law that is currently amended until July 2013 is allowing the use of aftermarket seats in a non factory locations. Basically this law is in regards to people who have added a back seat in a Rhino, Teryx & Ranger and will effect people who have added a rear bench in a RZR4 or XP4 with the idea of added a 3rd person in the back seat. The law was written to mandate only factory seat locations may be used.

Paul Cook the author of the bill had no clue what a Rhino was and had no clue that people put rear seats in these vehicles. Once he realized the significance of what his bill was doing, he pushed to amend the feet on the floor and the rear seat law. Due to time constraints the best they could do was to delay the mandate of no aftermarket seat locations until July 2013.

What this will do is allow legislation time to write a corrected bill with guide lines that allow seat conversions, yet make it simple enough for Law Enforcement to be able to visually see what is legal and what is not.

From what I gathered the written change would look something like this. All aftermarket seating locations will have to use manufactured aftermarket seats that can be bolted or fixed to the frame or chassis structure. All occupants must have proper seat belt restraints and proper roll cage protection must enclose that aftermarket seat location.

Basically 95% of the UTV's with rear seats already follow these guidelines. The law will make sure people dont just sit in the back of a two seat model or to keep people from making unsafe homemade seat locations.

Now for those who have RZR4's or XP4' and have added a rear bench seat with the idea of having a 3rd person in the back seat area this law will also effect you. So currently your rear back seat is legal until July 2013. Once the permanent fix is written and signed by the Governor then you will be good to go. But if legislation does not make this amended law permanent then your 3 seat bench seat will not be legal in California. So dont think because you have a factory 4 seat UTV that you can add a seat for a 5th and be OK.

Until Jan. 1, 2013.. all riders in a 1000cc or less SXS are required to wear regardless of age.

Thank you for this explanation, NIKAL - it's probably one of the most concise & clear ones I've seen. There's so much confusion about this new legislation, I can't figure out what's real and what's being made up or misunderstood. I've got a couple buddies who dumped a ton of $$ into Rhinos year ago to make them 4 seaters that are freaking out right now. If you go on Craigslist, you'll find people here in California (or is that, "Kalifornia") practically giving away their kid's RZR 170's for fear of being stuck with them after they are banned here. I've talked to a couple dealers who have told me that they're not even wanting to take any more 170's in until they know what the deal is.

It's just so typical that Sacramento would pass legislation without really caring to know WTF they are even talking about. As a Jeep guy for years, I always found the offroad community to be some of the BEST stewards of the backcountry and our trails, not backpackers. I've picked up more freeze dried food containers that I can count over the years.

I ran into one of these "rogue" LEO at El Mirage recently and before he started wriiting a ticket.
I said I am not going to sign it and you better read this, showed him the bill and the amendment. He asked if he could take a copy and send it in to his office. As I was not going anywhere, but back to camp. I said sure and he returned with it and Thank me for the input he was under the understanding no helmet meant all SxS would be cited now not starting Jan.2013. At least he was courteous and opened to talk and not write a ticket that I am sure I have to go to court and fight later. He was just poorly informed.

Not sure how there going to police the rear seat or cage deal on rhinos and such.

Not having a helmet is a little more obvious.

Oh and do not expect Paul Cook to do anything more he moved on and left us hanging
