Street Legal in Nevada

So, I live right on the edge of nevada and az...I know I am street legal in Az but what are the laws in Nevada???

I live in Las Vegas and sorry to say they are not legal to drive on the strets in Nevada. They will never be and that sucks. They will have to be registered next year with the DMV but not licensed.

violation of NRS 485.187 [.] or subsection 4 of NRS 490.520. If the driver of the vehicle is not the owner, a citation must also be issued to the owner, and in such a case the driver:

1.  May sign the citation on behalf of the owner; and

2.  Shall notify the owner of the citation within 3 days after it is issued.

Ê The agency which employs the peace officer shall immediately forward a copy of the citation to the registered owner of the vehicle, by certified mail, at his or her address as it appears on the certificate of registration.

Sec. 2.  Chapter 490 of NRS is hereby amended by adding thereto the provisions set forth as sections 3, 4 and 5 of this act.

Sec. 3.  “Large all-terrain vehicle” means any all-terrain vehicle that includes seating capacity for at least two people abreast and:

1.  Total seating capacity for at least four people; or

2.  A truck bed.

Sec. 4.  1.  Except as otherwise provided in subsection 2, a person may operate a large all-terrain vehicle on any portion of a highway that has been designated in accordance with NRS 403.170 as a general county road or minor county road if the large all-terrain vehicle:

(a) Meets the requirements set forth in NRS 490.120; and

(b) Is registered by the Department in accordance with section 5 of this act as a motor vehicle intended to be operated upon the highways of this State.

2.  The governing body of a city or county within which is located a highway or portion of a highway that has been designated in accordance with NRS 403.170 as a general county road or minor county road may by ordinance or resolution prohibit the operation of large all-terrain vehicles on any portion of such a road.

Sec. 5.  1.  Upon the request of an owner of a large all-terrain vehicle, the Department shall register the large all-terrain vehicle to operate on the roads specified in section 4 of this act.

2.  The owner of a large all-terrain vehicle wishing to apply for registration or renewal of registration pursuant to this section must obtain and maintain insurance on the vehicle that meets the requirements of NRS 485.185.

3.  If an owner of a large all-terrain vehicle applies to the Department for the registration of the vehicle pursuant to this section, the owner shall submit to the Department:

(a) The information required for registration pursuant to NRS 490.082;

(b) The fee for registration required pursuant to NRS 490.084;

(c) Proof satisfactory to the Department that the applicant carries insurance on the vehicle provided by an insurance company licensed by the Division of Insurance of the Department of Business and Industry and approved to do business in this State which meets the requirements of NRS 485.185; and

(d) A declaration signed by the applicant that he or she will maintain the insurance required by this section during the period of registration.

Sec. 6.  NRS 490.010 is hereby amended to read as follows:

490.010  As used in this chapter, unless the context otherwise requires, the words and terms defined in NRS 490.020 to 490.062, inclusive, and section 3 of this act have the meanings ascribed to them in those sections.

I understand what you're saying...fortunately for us up here (and in central Nevada) most of the roads that link backcountry routes are county roads.

Just the ability to travel a mile or two on a county secondary makes the difference between a short ride and an epic one.

I'm going to give it a shot next week. DMV in Reno has a mixed track record for me (sometimes they make stuff happen, sometimes they drag their feet) so we'll see. We already have the insurance, so it appears that all that's necessary is the registration part.

Definitely let you know what happens.

First of all, a big thank you to Crashbot2001, without their point I wouldn't have known about this.

Something that had always been represented to me was the ability to travel on the road for no more than 2 miles, to link trails. Thanks to the research from this thread, I found it: NRS 490.110 2.(b).

If you want to go more than that, then you need to register it. If you want to travel for long distances on (un)paved county roads, you need to register it.

For that registration, attached is a Word document with all the applicable regulations I could find.


Here's my checklist for next Tuesday at the DMV:

  • RZR equipped with:
    2 seats abreast
    Additional 2 seats (or) truck bed
    Headlamp
    Taillight
    Stop light
    Rear red reflector
    Operational muffler​
  • Registered as OHV
  • Titled as OHV
  • Insurance with BIPD 15/30/10
  • Registration fee of $30
  • Lots of patience

Update!

Sooner than expected, an update.

Soooo...having a bit of time available today, I gathered up all my documents and went down to the DMV main office in Reno.

What paved the way was carrying a printed copy of the NRS.

I was there for about an hour and a half. Thirty minutes were spent waiting in line, the rest were while seated at the counter while several of the nice folks there rushed about with looks of consternation. Apparently, they made lots of phone calls, and eventually talked with someone placed above both the DMV and OHV.

Here's what I learned:

  • Yes, it's the law. Has been since May 27th, 2013.
  • Yes, we've correctly interpreted the privileges that will be granted.
  • No, they (DMV) don't have any way to implement it.
  • OHV Nevada (the Nevada Commission on Off-Highway Vehicles) will be the administrator of this set of law(s).
  • OHV claims they will have something in place in "a couple of months" to register us. (no, I don't believe it either)
  • They plan on a "small little sticker" that shows you're appropriately registered to drive on the road.
  • It will be announced on the web site when active.
  • If you want to get more details, use the number 775.684.4381. A real person will eventually answer.


Sooo...that's what I found out. Personally, I will be amazed if they get this out by this time next year, if the OHV office's track record stands. And a "small sticker"?!? Riiiiiight.

I also asked for advice, and was chatted to by a very nice NHP rep. He said that what he'd do is carry a complete copy of all the NRS's that we can't use (like I placed in a previous post), as well as the insurance card for your RZR, and your current OHV registration... this shows compliance with NRS 490. Be nice to whoever pulls you over, and explain the law grants you the privilege, but you don't have tags because of bureaucracy. You'll probably get off if you're polite. A challenge in court will likely overturn any ticket anyway although the time spent will be a PITA.

Or, limit yourself to 2 miles. Carry the NRS for that, too.

When I get back home I'll be going to my local DMV and try to register. I'm expecting the same answers you received; however, if enough people try this it might help in getting the new law implemented. Also, I plan to write a polite letter to the OHV department asking about this and send email too.

After some digging, it appears that OHV, in actuality, is a section of the DMV. That's odd, because when reading their web site, it sounds like they are a wholly separate department.

They certainly don't advertise this, it only shows up accidentally (like at the bottom of this web page).

...I, too will send off some letters. Maybe it will help.

Looks like you found the info crashbot. I have been searching for it about 5 months when i was told about it. Glad I mentioned it to you.

Also part of the change in the law is the actually OHV sticker size. No longer going to be huge like it currently is. They are suppose to shrink to 3"x3".

One of the guys we launch rockets with, works for the state. He got sucked into the OHV sticker size debacle when it started.

His words? The OHV sticker started out with lots of feedback, some dealers, Fish & Game (who wanted a huge one, so they could ID you from a distance), some state employees who owned ATV/UTV's, etc. They couldn't come to a consensus, so it got left up to a secretary who split a piece of paper in half and used Word to compose what we have now.

I know NRS 490.083 says "at least 3" x 3.5" ", but, the current sticker is "at least" this size. At a launch last month he said the feedback for the sticker size has been horrible, however he's seen nothing that tells him the size or design will change.

<shrugs> it is what it is.

As a retired police officer, I will say that, IMO, a Rzr has a "truck bed" for carrying large items. I know we have a 30 gallon and a 16 gallon container in ours for storage, and it is in the rear bed.......The "only" police officer that might give you a hard time is a rookie out to make a name for himself and the first time a judge dismisses the citation and slaps his wrist for being a rookie, he quickly learns to be nice.....LOL

Once it is known they are putting plates on 4 seat utv's they will pretty much have to accept 2 seat utv's.

All this because the cheap ass cow county farmers bought cheap Chinese UTV's and wanted them played for farm use.

Visited my local DMV (Yerington) today and received the answer I expected. Which was "You can't get there form here". My local DMV had no knowledge of the new law. I informed them that I know the law has not been implemented yet; however, wanted to know all the requirements for registration for county roads. Was informed if and when it's implemented I would need horn turn signals and all the rest of the things required for street legal vehicles. I showed them a copy of the new law and what the requirements were. At this point several telephone calls were made and no one they talked to really knows what the new law is.

They tried to be helpful but kept insisting that turn signals horn etc would be required. According to the new law I read I don't think so. I suspect that that's how the people over in Ely are getting theirs registered. Like the sand rails I have seen around here with licence plates. According to my DMV if registered that way you could drive it on any highway. Also, they stated that the county would have to designate which roads could be used. I interpret the law to read. The governing body of a city or county can designate which roads cannot be used. Same thing I guess.

PS was called by the DMV and they talked to someone after I departed who stated they were expecting implementation some time after the first of the year. Hope for closer to January then December.
